Coming up this evening at 9 p.m., "Piers Morgan Tonight" welcomes Supreme Court Justice Antonin Scalia for a rare and candid sit-down interview.
Joining the Court's longest-serving justice in Washington D.C., host Piers Morgan asks his guest to recount his most-contentious case:
"Well, I guess the one that created the most waves of disagreement was Bush v. Gore," says Scalia, referring to the famed United States Supreme Court decision dealing with the dispute surrounding the 2000 presidential election. "That comes up all the time, and my usual response is 'get over it.'"
Noting that it was the Democratic candidate who brought the case into the Courts, Scalia says he hasn't lost any sleep over the result:
"No regrets at all, especially since it's clear that the thing would have ended up the same way anyway," recalls the 76-year-old. "The press did extensive research into what would have happened, if what Al Gore wanted done, had been done, county by county, and he would have lost anyway."

And then the Supreme Court took a case that was not in the provence of the court and litterally appointed George W. Bush to the presidency. That allowed him to invade an innocent country and be responsible for the deaths of over 3000 of our military, and hundreds of thousands of innocent Iraqi and drive us so deep in debt that his party is obstruction every single bill that OUR PRESIDENT HAS PROPOSED TO GET THIS COUNTRY GOING. If the supreme court had not appointed bush we might not be in the fix he and the republicans put us in. He says he was famous...what he means is he was and is infamous.

Please try reading the article. Gore put the case into the courts. If Gore had won there would have been a recount of each county and Gore would have lost. Fact checking groups and the media did at the time and they showed that bush would have won regardless. Yet the lie that Bush stole the election has continued for almost 12 years. Also just because President Bush didn't speak as eloquently as Pres. Obama doesn't mean he isn't intelligent. After all he has an MBA and they don't give those away. Also Bush has more common sense.

The decision didn't change the outcome. The votes were counted by all sorts of people, the press, several Liberal organizations, all with the intent of proving the Court, somehow, got it wrong. The Bush margin of Victory increased based on the certified results, not decreased under each of those recounts.

Oh dear. Have you read Bush v. Gore? It was predicated on vote dilution and upholding the meaning of the vote. Why? Because having continual recounts, and adding "newly found" ballots that could not be accounted for - without any procedures in place for identifying or marking them - was a violation of voters' rights.

There are links to the decisions right on the supreme court's website and you do not need a law degree to understand 90% of what is in them. In most cases you'll find that the scope of decisions are much more narrow than talk show hosts make them out to be.

We have seen many examples of this..duck hunting with Cheney with a case involving him on the docket, his outburst in the courtroom scolding the President with the recent immigration case, etc. Telling American's to "get over" one of the most contentious cases in American history of the Supreme Court, and then incorrectly stating that news sources stated Bush would've won anyway (multiple reviews of the counts have stated that Gore won), shows his blatant disregard of what his role in the Supreme Court should be, a disregard for democracy, and an ego that is out of control. Wow! It has been twelve years and you can't get over a Supreme Court decision. Someone is always going to be unhappy with any court decision, but you get over it. The members of the Supreme Court are appointed by the person who is President at the time there is an opening. Of course, they choose people who go along with their beliefs, so it is hard to believe they can be completely nonpartisan. I have noticed on major decisions that many times the so called conservatives will vote with the so called left leaning members, but I don't seem to remember the left leaning members voting with the conservatives on an issue. The 9/11 attacks occurred because of the Clinton Administration. The World Trade center bombing, the '93 shooting at the CIA headquarter in Langley, VA, the 1998 African Embassy bombings, the 2000 USS Cole attack. All the focus Clinton ever gave it was a couple tomahawk missiles. Which resulted in the 9/11 attacks 8 months after he left office. The hijackers all entered the U.S. in 2000 under Clinton's watch, no system was put into place to track potential threats. Complain about it all you want, but after the changes put in place by Bush, the U.S. has never had another successful attack against it.

I find it unusual to get such immature answers from SC justices ... even when I disagree with them, they at least tend to be more well spoken than "get over it" and "well it really didn't matter anyway." I mean what kind of person, let alone the highest ranking judges in the US could downplay the value of their job so candidly?
I agree with your comment. We are led to believe that Supreme Court Justices are towering legal minds; careful, thoughtful arbiters of the narrowest of judicial matters. The highest, and best qualified, court in the land with the mandate and ability to weigh the incredibly complex, far-reaching and unpredictable consequences of their decisions. They rule on laws that affect every American, and that establish precedent that will echo through history. When you see someone like Scalia, be flippant or dismissive, or someone like Clarence Thomas who seems resigned to never participate in the process and simply rubber stamp every decision, it undermines the people's confidence in the land's highest court.

I believe Justice Scalia to be a well-qualified member of the court. I also believe, however, that Justice Scalia is lacking in a certain personal decorum. Over the years, his comments to the public show that he has nothing but disdain for the American citizenry. If it will be recalled, Scalia was the Justice who announced that the Court was taking the case, and, accordingly, I had no reservation in telling my students, family, and firends that Bush would be our next president. Although I have always wanted to believe differently, the Court has become overly political. It is not hard to determine how a case will be decided based on the political leanings of the justices. Even with the recent decision on healthcare, many of us thought Chief Justice Roberts would uphold the law so that his legacy would not be remembered as being overly political. Even though Roberts upheld the law, he has not changed my opinion.

I voted for Gore. Actually switched to Republican in attempt to vote in primary for anyone but Bush. But it was clear the Supreme COurt made the correct decision. All the stalling, deadline extending crap thrown up by the Dems was appaling actually. By the next Pres election I was voting primarily conservative/libertarian. Dems lost me, and the start was all this nonsense.

Your facts are basically correct, your interpretation is not. What SCOTUS basically said was that the Florida SC was biased and unfair, much like you claim SCOTUS to be. They found that FL SC wanted something that couldn't possibly be completed in a timely and fair manner, that they asked for such a wide recount in order to effectively hand Gore the election. SCOTUS stepped in to prevent such a biased process to take place. You forget that the liberals on BOTH courts sided solely with Gore. The biases you claim cut both ways. Besides, Clintion had 8 years to stack SCOTUS if he wanted, but it didn't happen.
Clinton only appointed two Supreme Court justices, Breyer and Ginsberg. Had Gore been elected, he would have appointed two more, instead of Roberts and Alito. Scalia and Kennedy were appointed by Reagan. Thomas was appointed by Bush 1.

They should be independent, without party preferences and should be elected by the people of this country. Their role in applying the laws if this land are far too important to allow political preference to enter into their judgement. There should also be a mandatory retirement age of 70 years old.

Further, the legal basis for Gore v. Bush was contrived at best. Scalia used a theory that is laughable and refused to allow a full scale recount to occur, claiming there was not time on the basis that it was too late to permit a timely transition of power. He ignored the fact that at least once in the past, a presidential election took considerably longer to resolve, and there was no problem with a transition.

Neither Scalia nor Thomas are fit to be justices on the Supreme Court. Scalia is obviously prejudiced, and cannot give an unbiased judgement. And Thomas is not up to the task of rendering decisions, evidenced by his complete silence during oral arguments and his refusal to contribute written opinions or judgments, just silently following however Scalia votes.
I disagree with Kennedy, Alito and Roberts, but they at least have consistent and thoughtful conservative judgements. I think they make the wrong call due to their conservative background, but they at least treat the court with respect, instead of a pulpit from which to rail like the thin-skinned smug and political Scalia.

Yes it is supremely unprofessional for a Supreme Court Justice, who is tasked with having an impact on the final say on justice in our nation, to have such notions, yet does it really matter when deciding if Bush won the state? Our president is decided by electoral college only, and it is common knowledge that state electors are not required to vote according to the districts they represent. No one disputes the outcome of Florida's electoral college vote: Bush won more votes. It doesn't matter if he lost the popular vote because that's simply how our election process works. Even if we were to assume that Gore won in Bush v. Gore, there is no mandate or precedent demanding that Florida do an electoral re-vote. Gore still would have won the popular vote but still would have lost the electoral vote. It's not like this is the first time such a scenario happened. In 1888, Cleveland won the popular vote but lost the electoral college vote to Harrison, and Harrison became president.
The system that our country has, the electoral college, is the thing that most people have a problem with when they talk about the whole 2000 election mess. It's improper to say that Bush stole the election through the Bush v. Gore outcome. Change the electoral college system.

Is there scientific evidence that Gore should have won? How about all the exit polling that showed that the majority THOUGHT they had voted for Gore. That's why the networks initially called the Florida results for Gore. The statistics they used and the evidence is as good as can ever be. NO ONE has ever said that Bush won the exit polls. But there were so many votes lost by bad and confusing machines that the counted vote may have turned out for Bush. The evidence of large numbers of votes being lost by the bad ballot process is undeniable.

I mean, if Gore served as president per wishes of the American people, the World Trade Center would still be standing, the US would not have started and lost two more wars, the US would not have brought about a global recession / near depression, and the US Federal budget would likely be balanced (and maybe even running a surplus). I think you have to figure that when you negatively impact the lives of close to 7 Billion people, well, you have to allow that a few of them won't easily "get over it" – at least not as easily as a man with no morals and no conscience.

The Florida Supreme Court was trying to change election rules after the election. The US Supreme Court simply put a stop to that illegal action. In the end, there were zero recounts that put Gore on top. When will you whining liberals get a hold of simple reality?

Al Gore received 50,999,897 votes while Bush v2 got 50,456,002. This is why the electoral college should be done away with, or at the very least it shouldn't be all or nothing. In that election, the question was the status of electorial college delagates and weather they were qualified to cast votes in the electorial college.
Congress decided that it would set up an electoral college commission to award the votes on a case by case basis to one candidate or another.
The precident was set, fast foward to 2000.
Congress should have taken the precident of 1876 and used it to effect the desired results, thereby keeping the election results completely within the legislative branch, and keeping the judicial branch at bey over weather it has jurisdiction in picking a president.

Scalia proves again his political injection into his horrid, treasonous Bush v Gore decision, with his WRONG statement that "the outcome would have been a Bush win anyway". FIRST, it shouldn't matter to the SCOTUS who "would have won". SECOND: Scalia is making a hyper-political statement when he says the media review of the votes would have resulted in a Bush win. In fact, the opposite is true. The media review showed that, in ANY scenario: include dimpled chads, exclude them; include pregnant chads, exclude them; etc, that GORE WOULD HAVE WON.
Where Gore would have LOST is the NARROW recount that Gore was requesting: certain counties only. But that is not what the SCOTUS put a stop to. The Florida Supremes told Gore: "no more games, no cherrypicking, recount ALL the counties". And the media count proved: Gore won by ANY STATEWIDE STANDARD.

Actually, in most scenarios, a statewide recount would still have favored Bush. Only using the most liberal methods of determining questionable ballots, would Gore have prevailed. If you go through and read the studies you will see that.

Clinton balanced the budget. By definition he created a surplus rather than a deficit. Whether or not he paid off any part of the debt I do not know. Scalia helped (1 of 9) stopped the counting of votes. Scalia said there wasn't enough time to count votes. Bush won. Bush got 4000 troops killed in Iraq. Bush froze the economy. "Get over it" He won't address the facts, and my question was always simply this: After the Florida Supreme Court ordered a new "re-count" (which had begun) why did the US Supreme Court suddendly HALT that very re-count while they began their own review? Only to say later – as part of their own justification to handing to election to Bush – that there was no longer "any time" to "re-count" the ballots. Really? You couldn't allow the "re-count" to continue because you knew what the final "decision" would be. Lackeys! P.S. Is the public aware that the final "official" vote count had Gore beating Bush by more than 500,000 votes? Bush was given the electoral win and we all know the rest. Yo, Scalia! I had my say and now am over it!!

America voted for Al Gore for President, but the Supreme Court selected George Bush who squandered a 5.6 trillion surplus, lied about WMD's and involved us in a 'war of choice, not necessity,' declared 'mission accomplished among many unAmerican activities. And Justice Scalia tells America to just get over it! Journalists from a number of News papers counted the votes in Florida and Ål Gore WON!
Justice Scalia is inimical to our Democracy. He has displayed contempt for our Democracy and our Supreme Court. He has no shame! At long last, he has no decency!
Our Founding Fathers were brilliant and thoughtful and of course they were Protestants and Deists. Our Supreme Court was designed by and for Protestants and Deists and now there are no Protestants on the court designed for and by them, thus the diminished quality! I weep for my country!
Sadly, I never thought I would live the day to listen to one of our SUPREME COURT JUSTICES talk so much partisan politics. He makes many Americans lose respect so deeply held for our 9 SUPREME COURT JUSTICES. He is also a very scary person of power, as it is clear that specific legislation that needs to be heard before his court faces the likellihood that he can not or will not provide a FAIR OPINION. This has got to be the most partisan supreme court in my lifetime. I just pray that somewhere along the line, Justice Scalia matures and takes his appointed position with more respect.
I believe that avoiding prepared foods could be the first step to lose weight. They will often taste fine, but processed foods possess very little nutritional value, making you take more in order to have enough energy to get through the day. Scalia is a disgrace to the Court and to the nation. The Bush v. Gore decision was outrageous tripe and Scalia knows it. I, for one, will never "get over" the fact that the Supreme Court has been bought and paid for by the right wing.

If I had committed a gross act of injustice so devoid of impartiality that amounted to a crime, like stealing an election... If I had defrauded the American people by stopping a vote count in the election process of a "democracy", and then claimed that the "time was up" so as to deny the election of the people their rightful choice of leadership, I might take the position ;that others should "get over it" as well... Except for one small detail... I'm not corrupt, morally bankrupt, or unethical enough to perpetrate such fraud to begin with!!!

All branches of our government are partisan. The courts are no more honest than the other branches of our government and are just as suseptible to corruption and unending displays of ignorance. Get over it, lol.
I guess I'll work on "getting over it" when this my country has fully recovered from the disasters that flowed from the illegitimate presidency of George W. Bush. Scalia is one more good reason to keep Republicans out of the White House.

Wouldn't use the 'R' word but for Piers to go at that guy as he did was frankly awful. Lets consider that while the generators failed (they always were going to) the contingency plans worked. And thank you to all those National Guard personnel who contributed, truly an admirable humanitarian effort. The Bellevue rep dealing with disaster recovery – Sir you were wronged. We all know you can only plan so far. Were lives risked – yes (its a disaster for goodness sake). Were lives lost? – I expect those national guardsmen were the epitome of carefulness when dealing with those patients.
Shame on you Piers for your shoddy treatment of this individual.. Without him can you even entertain the possiblity that the outcome could've been much worse ? Respect the man for doing his job, and for him and the national guard coming together to find a solution without more lives being lost.

Scalia suggests that what he and the conservatives on the Court did was okay, "especially since it's clear that the thing would have ended up the same way anyway." First, I'm not sure I believe that; second, it's irrelevant to the point of whether or not their decision was well-reasoned or fair (which, by the way, it was neither); and third, had the recount gone forward and Gore was found to have legitimately lost the election, those who opposed Bush would have at least felt that the election was a fair one, not one that was rigged by the conservatives on the Court. The Court's decision was the beginning of the vitriol and disunity that pervades the political process today.
