Thomas Mesereau details the precise elements which comprise self-defense in the state of Florida
With the defense resting in the George Zimmerman trial on Wednesday, the attention of the nation now turns to closing arguments, and ultimately, a verdict.
With the outcome of the case hinging on whether or not the six women jurors will believe the defendant acted in self-defense, "Piers Morgan Live" invited Thomas Mesereau to share his unique insight as part of a live interview:
"Piers, I don't practice [law] in Florida, but I have to believe there's going to be a jury instruction on causation," revealed the criminal defense lawyer. "In other words you have to have caused what the crime was."
With the jury set to receive the case Friday afternoon, Mesereau marveled at some of the complexities that the half dozen Sunshine State citizens will be forced to mull over:
"I have to believe these prosecutors are going to look at the jury and say, 'if a Florida law allows someone to profile someone, disobey police instructions, bring a deadly weapon with them, confront someone, threaten them, assault them, and then when they respond, shoot them dead, is that self-defense in Florida?'" the guest laid out for Piers Morgan. "'Ladies and gentleman you're going to decide that question.' And I suspect it's not so simple."

I am surprised that neither the prosecution nor the media has argued about Trayvon Martin's right to use the "Stand your Ground" law in defense of himself and with his own arms. Is it the State of Florida's position that the "Stand your Ground" law ONLY applies to people with GUNS?

First, Trayvon did not live in that neighborhood nor did his mother or his dad. Mr. Zimmerman was a homeowner and you can view recent property transfer records and see how property values have diminished, most likely due to the crime that Mr. Zimmerman and other homeowners were trying to eradicate. Trayvon's mother and father were divorced and Trayvon was living in Miami with his mother. He was recently suspended from school for having drugs in his possession as well as break in tools and he was kicked out of his mother's home and put on a bus 200 miles to Sanford. Trayvon's dad was remarried but he was "staying" in the home of another lady in the gated subdivision where Mr. Zimmerman owned a home so Trayvon did not live in that home and had only been a guest there for a few days so he was not walking HOME. His dad's girlfriend was aware of the crime spree in the neighborhood and should have warned him of wandering in and out at night and normally gated subdivisions are not public streets. In fact, the girlfriend and dad were out that night and he didn't even know that his son had died until a couple of days later. All of a sudden, they are grieving (millionaire) parents whose dad left him at age 5 and the mother had kicked him out the week before, according to his text messages. He had drugs in his system and in FL if you are under 18 you need a parent's consent to get a tattoo and he had 2 so which parent approved those? The judge wouldn't allow the messages but he talked about all of the fights he had been in as well as looking for a gun to buy. Where does the blame lie? Not with the non emergency person who had no authority to order anyone to do anything but what about the 2 parents who should be arrested for neglecting this so called "child". Why weren't they with him that night instead of one being 200 miles away and the other married but being out on the town with his girlfriend? They were quick to to file suit against the homeowners ass, even though they didn't even own a home there. Shame on them.
TRAYVON IS A TEEN, WHAT WAS ZIMMERMAN LIKE WHEN HE WAS A TEEN ? THEY CAN'T CHARACTER ASSASINATE ZIMMERMAN BECAUSE HE IS MUCH OLDER AND HIS PAST IS BURIED WITH SPACE AND TIME, TRAYVON WAS LIVING HIS TEEN YEARS, DEVELOPING HIS CHARACTER HIS TIME WAS LIVING IN THE PRESENT NOT FAULTERING ABOUT THE PAST, ZIMMERMAN ASSASINATES PARTICULAR TYPES OF CHARACTERS BECAUSE OF HIS DYSFUNCTIONAL AND MALICIOUS HERO COMPLEX. BECAUSE OF FAULTERING, AND I HATE TO SAY THIS, BUT MANY PEOPLE THRIVE ON THE FAULTS OF OTHERS AND EVEN MANUFACTURE A SYSTEM OF FAULTERY TO EXPLOIT. Well said Donna! You have certainly outlined the truth about Travon Martin and it boggles my mind why this did not come up in court. Further more they insist on calling TM a 'child' but in fact if he had committed a crime he would appear in court as an adult.
Yeah Donna, you can run your mouth about what the parents did not do with their son. Some parents are not perfect and neither are their children. Since when it is acceptable for someone to follow a suspect and also approach a suspect without any reason of guilt. Travon was free to walk where ever he pleased. Zimmerman seemed to be the kind of guy that did not mind his business. Once he called the police he should not have approached Travon. He was not a police officer. The police would have come and arrested Travon. That's their job. A person is innocent until proven guilty. It was a smart decision for him not becoming a cop. He would have been one of the worst on the force. The fact is that he killed someone and he should get the death penalty. His time is over. There is no reason to have a trial for him. Anyone that carries a gun and that person is not a police officer or in law enforcement, means to kill someone. Zimmerman is a hateful killer. If he walks free he will end up in prison again just like OJ.
