A trio of attorney's offer legal insight in the story of the motorcyclists and the SUV along Manhattan's West Side Highway

As the extraordinary multi-vehicle incident along Manhattan's West Side Highway continues to enrage and horrify those that have watched the various videos, on Thursday evening "Piers Morgan Live" asked a trio of legal minds to offer their specific perspectives and expertise.

Joe Tacopina is not as of yet formally involved in the case, however what's he's seen of the altercation has lead him to believe that the driver of the Range Rover – Alexian Lien – acted within the law:

"There's clearly in my opinion, no wrongdoing. This is a tragedy what you're seeing here, but what I'll say is this: the law is if he reasonably believed that he was in danger, when he acted, then he's good to go," explained the defense attorney. "Understand this: throw yourself into parent mode on top of that. He has a 2-year-old in the back. These guys have been surrounding his vehicle, basically since midtown, all the way past the George Washington Bridge, clearly acting like a gang of thugs."

H. Benjamin Perez, of Perez & Cedeño, P.C., is representing motorcyclist Christopher Cruz, and he views the situation differently:

"Here's the problem with what Mr. Tacopina's saying. First of all, he is assuming that all of these bikers are together, he's assuming that this is a biker organization," explained the man whose client is accused of starting the bloody encounter between the bikers and the SUV operator. "My client doesn't know these other bikers that are around him. He's there with specific, two to three other friends, and they're all heading north."

In response to Tacopina's assessment that the bikers had surrounded Lien's SUV "like a pack of wolves," attorney Gloria Allred insisted that the driver acted too forcefully:

"Was it reasonable for him to believe...that it was going to be imminent use of deadly force against him by my client," asked the woman representing one of the other motorcyclists, Edwin Mieses. "[He] was only standing in front of his car with his back to the SUV telling everyone, move on, move out."

      I used to live in Washington Heights. These guys have been terrorizing the neighborhood for the past 20 years. When they drive by the streets (sometimes 20, 50 or a hundred of them), you better get out of the way. Care have to stop, go on the side, and wait 15 minutes until they pass by. They are violent, mostly involved in gangs, and have extensive criminal histories. I even saw them beat up a girl in the middle of the street and nobody did anything. People are scared of them. I was very young at that time and I just ran home. I was too scared to call 911. When I was older, I repeatedly filed complaints to the nearby precinct when they would pass by at 2am in the morning and wake up the whole neighborhood. The police told me it's hard to catch the guys b/c they are on the move. Really?? Rumor is they are connected w/ corrupt policemen and that is why they are protected. I have since moved out of the neighborhood and that's the best decision I've made. Gloria Allred, I am so embarrassed for you! You have sunk so low! You should move into that neighborhood and see for yourself!

        I was on 125th to take the subway to a Yankees game. I saw one of the bikers smashed a side mirror and the driver couldn't do anything, there were too many of them and they just sped off. I am not sure what the bikers was mad about to to that, I didn't see the driver do anything to them.

      Same here. What an abomination that Allred is defending this thug. What an abomination that the thugs are going to be defended in any way. They are guilty of bringing on trouble, of baiting the driver. Why aren't the police policing these thugs, and getting them off of the roads. Why do crimes have to get to epic proportions before they get attention. Violent government; violent society, with little respect for human life. A so-called industrialized society should not have the level of violence and thuggishness, and corruption that the US does. The gov't is corrupt and violent. The populace follows suit, and takes it all in stride. Other civilized nations wouldn't not tolerate a fraction of what the US puts up with on a daily basis. No end in sight, as murderous, warmongering thugs are ruling the country. There is a direct correlation between a violent gov't and a violent society.

      Her client has a 6 page criminal record, and has a suspended license. The man is 33 years old and raps about selling cocaine and shooting people. When they surrounded the SUV, imagine you have these bikers smashing your mirror and slash you front tires with scary face paint on. Mieses has a joker face paint approaching the SUV.

    "Roll up my windows"? LOL. AFTER THE TIRES ARE SLASHED?

    "He was a pedestrian."... on the middle of a highway? "He had his back to the car." Smart thing to do, and does the video really show that?

    Like seriously Gloria. The video shows one of the bikers slamming their helmet or hand into the window behind Lien BEFORE he drove off. At that point, any damn parent would take off. There's a 2-year old back there!

    And the analogy to a baseball game? When people go to a baseball game, they're not breaking the law. When people run red lights, operate a bike without displaying a license plate, and go over sidewalks, THAT'S BREAKING THE LAW.

    I understand that a lawyer's job collect large amount of money from their client in exchange to get them the best possible deal they can in court.
    1. Why did Mieses loose his drivers license at the first place? 2. Why was Mieses in the middle of an irate group of biker? 3. If the SUV driver started the confrontation, why did the bikers took the matter in their own hand instead of calling the police and let the police do the chase and investigate the accident?
    4. Christopher Cruz (the biker who slow down in front of a moving SUV) went from the far left lane to the middle lane, slowed down his bike while looking at the SUV. Knowing the size of his bike relatively to the size of the SUV, if he was looking for his fellow lost in the crowd as he claimed, then the front of that SUV would have been the worst possible place to be. Unless he has X-ray eyes that could see through the big, heavy and black Range Rover with tinted windows.
    6.It's clear that this was a biker's gang looking for trouble, and they were part of the gang. If not why did they continue to ride in a pack of bikers that was breaking all kind of traffic laws, from ignoring red lights, to riding on sidewalks, riding against oncoming traffic, etc.
    7. Stop, roll up the windows and dial 911, when surrounded by bikers like these, your tires being slashed, banging on your SUV, your wife and 2 years old daughter in the SUV?

    8. Just how much money Gloria and the Perez are collecting from their clients to make these claims with straight faces on tv?

    Shameful!

      For poster Yesus: I agree with your 7. point. Those lawyers, defending the bikers, must be smoking something. For a vehicle to be surrounded, attacked, probably hearing profane language, and having your tires slashed...gee, that sounds friendly to me. Why would anyone not be worried about their safety?? Gloria and the other atty lost credibility. It's so amazing how everyone has to break down every detail, "Oh, he was just a by stander", to twist it so no one takes any accountability for anything. Truly shameful.

    How can any one think this is the truth. He was slowing the car down. When you beleave your in harm way you can kill. The bikes are together not they are all driving together. A gun would have stop this just thinking he had a gun. But this is the point of not having guns. Bad guys rule good guy fear.

        Actually, these are criminals and driving on a suspended license, they were biking recklessly through NYC and not obeying any traffic law. And these guys had face paint on, and I am not talking about clown children face paint. If Lien intent was to hurt these bikers, he would have side swipe Cruz when he was riding beside the SUV in the same lane.

    These bikers were all together they all stopped at the same time and took over that highway as a coordinated act that denotes organized group mentality. Immenent danger was proven when a deadly weapon was produced to slash his front drives side tire. At that point it is a life and death situation and Lien's actions are justified.

    Just because people seem scary, it does not mean they are. Just because you can identify with the driver, does not mean that he was in the right.

    The bikers that attacked the driver should be charged, but the driver should also be charged with running over the biker that was doing him no harm (it is irrelevant that the biker did not have a license or that he has a criminal history, he was doing nothing to the driver at the time...why does this remind me of the Trayvone Martin case?) he personally was not a threat to the driver at the time he was struck.
    It is fascinating to me to see how differently people view this incident (where they identify with the driver and find the cyclists scary) and the one with the woman in DC who was killed (where they find the woman scary and identify with the police).
    The tactic of the lawyer for the driver (repeatedly calling the bikers animals and 'a pack of wolves') was also interesting, research has shown that if you call people animals or monsters, psychologically people are more likely to see those people as 'other' and are less likely to feel sympathy for them and more willing to see punishment handed down to them that people in the same situation who are not referred to in that way.

    He knows that if people start looking at this objectively, rather than emotionally, that the actions of his client would not look so good.

    Finally I found Mr. Morgan's asking the lawyer for one of the bikers if he had children to be highly offensive. He did not ask the lawyer for the driver if he had ever had someone he loved run over by a car and paralyzed, or the woman defending the biker if she was a man (how could she possibly understand what that is like?).

    Just because you are a parent and are scared, does not mean that you can injure others and get away with it simply for that reason.

      Every biker on that scene is responsible for MeeZee's demise. The Range Rover was targeted because it was expensive. The video plainly shows that Cruz brake-checked it deliberately. The driver stopped responsibly, however, when all the bikers stopped to menace and terrorise the occupants by beating on the Rover and slashing it's tyres, it's blatantly obvious that Lien and his family were in danger. The driver did exactly what I or ANY father in his position would do: he floored it to protect his family. It was MeeZee's fault for riding with no license and flaunting every traffic law while putting pedestrians and other drivers in harm's way. He was NOT obligated to slow down and cede his right-of-way to a gang of lawless biker punks in adult bodies.

        The SUV's driver got beat up because he ran over Edwin. There was no pounding on the windows with helmet or any sign of apparent danger to the family in the Highway confrontation, everyone was acting relatively civilly until the SUV driver "snapped" and chose to run over the bikers.

        Leslie, I am not sure what video you are watching but the one I watched I slowed down and looked at each frame blown up and one thing I can clearly see is a biker punching the drivers side window on the initial stop. I can not say I saw anyone slice his tires on the passenger side and that could have very well happened when he run over the bikes. Between bikers blocking him off, being totally surrounded and the punching of the window I do not think the bikers were looking to chat. Watching that video there were many helmet cams, be glad when the owners get the nads to release it. Also, out of all the interviews I have not heard 2 bikers stories even matching.

      Someone should read the news: were those bikers just waving their hands and smiling to Mr. Lien when they first stopped the vehicle? Were they NOT doing ANYTHING to his vehicle? Everybody knows if they could open the doors on highway, Mr. Lien would have been dragged out and beaten just the same way. Somebody slashed my tire and trying to grab me on the highway, I will floor it for sure.

    If a Boston Celtics fan started a fight with a LA lakers fan in the Staple Center, does the Celtics fan has the right to use deadly force against the Lakers fans simply because he feels scared being surrounded by thousands of Lakers fans in the Lakers home court. No, the hundreds of other Bikers were merely spectators, there is no evidence showing they know each other or act as a group collectively. Perhaps the Bikers just stopped the SUV requesting an apology, and the SUV driver over reacted and started bulldoze people to get away from the situation, or SUV snapped because he felt belittled by the "lowlife" bikers (like a lot of Americans are feeling) demanding an apology from a successful businessman like him. The SUV driver's reckless action didn't save his family, he put himself and his family in a much greater danger because the beating happened ONLY because he purposely ran over Bikers. It is too early to tell, don't rush to conclusion please. Piers Morgan you are profiling the Edwin and Bikers as up to no good thugs just like George Zimmerman did to Trayvon Martin, you have lost all your rights to criticize GZ because you are doing exactly what he did.

      Les your example of Celtics and Lakers fans are totally not identical situation to what really happened. First, you are in Lakers' home court, so you are surrounded by laker fans, that's normal; second, if you are beaten by a bunch of lakers' fans and they surrounded you, tore up your jersey, push you, splash drink on your face, slash your tire if you are on wheelchair so you will not be able to go anywhere, probably, then yes I would do whatever I can to get out of the crowd and be somewhere safe. Be noted, driving a car out of the bikers' gang is not using deadly forces and Lien is not pointing his vehicle directly to anyone but the road. You should be responsible to yourself to not standing in a vehicle's hood, that's common sense, especially in such a unique situation and you are on a freeway! Would you consider being beaten by home team fans everytime you go to a guest game? No! Will you consider being ran over by a vehicle if you are WALKING on the highway?? At least I do and I think about that even crossing a backroad. That's the risk that paralyzed jerk willing to take and now he deserves the outcome. So, in sum, highway is not bikers' home court, it's public area and surrounded by lakers' fan does not equal to surrounded by bikers who intentionally stop you and slash your tire. I am sad to see you are confused by these two and hope you can recover soon.

        Those are good points, but the tires slashing are still assumptions at this point of the investigation because the tires could be damaged during the run over. The SUV had stopped, Edwin parked the bike in front of the SUV because he wasn't expecting Lien would snapped and charging through in fullspeed all of a sudden. It is a different story if Edwin parked his bike in front a moving SUV deliberately to try to stop it. The pounding on the windows with a helmet and beating took place after the SUV ran over the bikes, you can't use that to prove the SUV was in grave danger if Lien didn't break away, as all the parties were acting civilly shown in the videos. Too many pieces of the puzzle still missing to make a judgement. I am not totally on the Bikers side, just pointing out ways the SUV driver may be responsible.

    You can't surround vehicles on the highway....on foot or otherwise. If Mieses felt like he needed to intervene and defuse "the situation" in such a fashion that he couldn't even take the time to move his vehicle from the middle of the highway, then I would imagine the situation was looking quite dire. Which, you know, the Liens also probably picked up on. LOL. Allred is a nutter.

    If I put myself in the SUV driver's shoes I would be very scared in that situation too being surrounded by hundreds of Bikers, therefore I would tried to do everything in my power to avoid getting myself into that situation before the conflict happens such as yielding to the Bikers or avoid doing anything to provoke them. Did the SUV driver provoke the bikers, did the SUV driver bumped into other bikers prior to the altercation as Gloria claimed? You can't put yourself in a dangerous situation by confronting the bikers or initiating the conflict and claim self defense. Judging from the video the way the SUV just bulldoze over all the standing by people without any regard to human life is way more horrific to me than all the other events that took place in the video. wait until all facts all in, too early to make judgement.

      Under the law it doesn't matter what Lien did prior to being surrounded. It doesn't matter if he was shooting bikers. They had no legal right to surround him, stop him, detain him. That's why Christopher Cruz' lawyer jumped far far away from that argument and went with "just changing lanes." Holy moses. Are you really that ignorant of the law?

        We have every right to apprehend criminals as a citizen, if the Bikers thought they witnessed a hit and run they have every right to get out of their bike to check on the situation, or step aside to wait for the cops to arrive to assist the investigation as witnesses. It is way early to tell if the other bikers were in this together or mere spectators. Besides, was the SUV truly surrounded? all the bikers shown in the video were all behind the SUV, it looks more to me the incident had blocked the traffic and the bikers behind were just waiting to get through. only 1 or 2 bikes were in its path of the SUV as it was breaking through. In fact only a few bikers were actively involved in the situation.

      I believe that's blaming the victim.

      According to Gloria, we can't consider anyone's prior actions. At the time he got run over Mieses wasn't on his bike, so his illegal bike riding's immaterial. In that case why should any alleged other "prior" bikes, who haven't come forward to say they got bumped after 2 weeks, be material? All we have is Gloria saying her investigation reveals Lien might have done something to other bikes, and a few bikers saying they think they saw or heard about Lien doing something to other bikes.

      I agree, but luckily some of the early evidence was the video, without which as others have pointed out "we'd have a different story".

    You have VERY little rights or protection under the law to pursue or detain someone you think has committed a crime. If you get hurt in that process, that's a risk you take. If you think someone is driving dangerously you call the police, you follow at a safe distance to get license plate number. You are not the police and you have no right to put yourself in the middle of a public highway in front of a vehicle. lol. If all the bikers were behind the SUV how did they get run over in front of it?? Doesn't matter if they were together or not. You can't put yourself in the way while someone is in a life/death situation and complain when you get hurt as they flee. Hence, why the Liens haven't been charged with anything.

    This is sad. I will not believe the story that filthy attorney made- it is her sole intention to get money from Lien and that's all. She represents nobody but herself and uses her "client" as a weapon. It is also ridiculous to defend the biker that he was trying to help Lien. I'd say he was just turning his back to the SUV so his friends can take a picture of him pulling over the SUV and post on Facebook. Yeah that's what I think and it makes a lot more sense.

    If the Bikers wanted to "SURROUND" the SUV they should block the SUV's path with 30 bikes instead of just 1. By putting your life on the line to arrest an alleged criminal does not waive your right to sue for compensation from the alleged criminal, let the court decide then. everyone has the right to resist a citizen arrest if he thinks he is innocent, just be prepared to face the civil lawsuits, especially if your net worth is in the millions.

        A spine and independence is priceless to anyone regardless to his social status. I find it hard to believe so many people thinks there is someone who deserve to be paralyzed without an examination into the incident objectively and fairly from us. If the court decides Lien is not responsible and Edwin deserved it so be it, but a paralyze man deserve a chance for us to look at this case objectively, stop the unnecessary name calling and smear please. Have you seen fruitvale station? a man's past should not be a hurdle for him to fight for justice in this situation.

    Obviously, lawyers have no interest in "truth", they simply want to win their case. The reason we are seeing the parade of defense lawyers and clients all over the media is to counteract the video and create enough "doubt' in the public for the jury trial . This strategy would work if the public were in generally a good mood. Unfortunately, there have been so many stresses (debt, economy, shutdown, etc.) lately that has created a mostly outraged and fearful public. Most reasonable people would conclude that the motorcyclists are out of control. The lawyers and clients will be quite happy if they get slapped with mischief or menacing and get a shorter stint in jail/prison since some of them have already been there (no biggie!). I would like to see the lies and half-truths fact-checked point by point coming out of the mouths of the lawyers/clients/plaintiffs for the public to see. After all, they are not sworn in when they do these interviews they can spin whatever they want! I say enough... put each person (including lawyers) in a room to be terrorized by a group of anti-Americans and let's see what they do.....
